Review of the Trans-Tasman Mutual Recognition Act (Western Australia) 2007

Interested parties are invited to make submissions to the review of the Trans-Tasman Mutual Recognition Act (Western Australia) 2007.

Western Australia has been participating in the trans-Tasman mutual recognition scheme since 1 February 2008, after the Western Australian Parliament adopted the Commonwealth Trans-Tasman Mutual Recognition Act 1997

The trans-Tasman mutual recognition scheme as it applies to Western Australia allows, subject to scheme exceptions:

  • a good that may be legally sold in Western Australia to be sold in New Zealand and vice versa regardless of differences in standards or other sale-related regulatory requirements between Western Australia and New Zealand; and
  • a person registered to practise an occupation in Western Australia is entitled to be registered to practise an equivalent occupation in New Zealand and vice versa without the need for further testing or examination.

Western Australia has been participating in the national mutual recognition scheme since 1995.  Further information on the national and trans-Tasman schemes are available on the COAG website (www.coag.gov.au).

The review is required under section 6 of the Act, and will focus on the operation and the effect of the scheme in Western Australia.  On completion of the review, the Premier as the responsible the Minister, will table a report in Parliament which includes a recommendation as to whether Western Australia should continue participating in the scheme.  The Terms of Reference for the review are:

  1. to review the operation of the Trans-Tasman Mutual Recognition Act 1997 (Cth) as adopted by Western Australia under the Trans-Tasman Mutual Recognition (Western Australia) Act 2007; and
  2. to review the effect on Western Australia of the Trans-Tasman Mutual Recognition Act 1997 (Cth) as adopted by Western Australia under the Trans-Tasman Mutual Recognition (Western Australia) Act 2007.

Comments are particularly welcome on:

  • examples which illustrate the impact of the trans-Tasman mutual recognition scheme on goods markets; and
  • the impact of the trans-Tasman mutual recognition scheme on the mobility of people employed in registered occupations between Western Australia and New Zealand.
